The American University Law Review’s recent event on scandalous marks was covered by Bloomberg BNA’s Patent, Trademark and Copyright Law Daily: “Trademark practitioners discuss whether marks incorporating terms such as ‘WTF’ or ‘MILF’ violate Section 2(a) of the Lanham Act’s prohibition on the registration of marks containing immoral, deceptive or scandalous matter at an American University Law Review event that was held April 11 at Arent Fox LLP’s offices in Washington, D.C. ‘The meanings of these terms are not considered offensive anymore due to the manner in which they are used by the public and in the media,’ Administrative Trademark Judge Linda Kuczma said.”
